A Settlement Agreement is a contract used to end a relationship between an employer and an employee. These agreements are used when issues at work are not resolved effectively, if there is a request of compensation, for redundancy or for any other reason.
The benefits for you are that you know how much money you will receive in return that you agree not to bring any future employment claims.
Why do I need to speak to a solicitor?
A Settlement Agreement is not binding under current employment legislation until you take advice on it from an independent adviser, usually an employment law solicitor. This is why you a recommended to seek advice from a solicitor. Your solicitor can review the contract and help you to make sure that the agreement is fair and legally correct.
Who pays for the Settlement Agreement - the employer or the employee?
In all most cases the employer will offer to pay towards you getting this independent legal advice. If the agreement is straightforward, we can provide the advice you need and in many cases the contribution paid by the employer would likely cover our charges to you. If there are more complicated issues depending on your individual needs or if you decide not to sign the agreement, you may need more detailed legal advice. If there are more fees for you to pay we tell you up front before the work is progressed.
