Children:
We will encourage you, where possible, to try and resolve the children issues amicably between you. Unfortunately this is not always possible.
In these situations you may need advice/action on the following:-
Parental Responsibility order
• this confirms your status as a parent and allows parties to have the ability to make decisions over the child
Contact orders
• this defines what contact the absent parent is to have with a child
Residence order
• this is an order confirming whom a child is to live with
The child's welfare is paramount when considering what orders are required. The courts will take the following into account:-
• The wishes and feelings of the child, this is subject to the child's age and understanding
• The physical, emotional and educational needs of the child
• The likely effect of any change in circumstances of the child
• The age, sex and background of the child
• Any harm the child has suffered or is at risk of suffering
• How capable each party is in meeting the child's needs
In the case of adoption and care proceedings, sometimes the social services will become involved. If they do we suggest that you instruct a solicitor as soon as possible.
