If one party is threatening or violent to the other party...
Under these circumstances the following action may be required:-
Police involvement
• If the police become involved, criminal charges may be brought and bail conditions attached to protect one party.
Letter before action
• We can advise you on the suitability of sending a letter to the other party warning them that they must stop there threatening or abusive or violent behaviour and explain that if there is a repeat of such then court proceedings will be issued against them.
Court proceedings
• If issued you will be advised on applying for non-molestation* or occupational** order. Both orders are not long-term orders but can be extended or enforced if they are breached.
* A non molestation order is an order stopping the one party from pestering, harassing or threatenong the other party.
** An occupational order is an order that regulates who has the right to live at the family home.
